The present general terms and conditions of sale apply to any order placed on the website. https://www.fissore.com/en/ of FISSORE S.p.A.

The "Order Confirmation" by the buyer implies the unconditional acceptance of these general terms and conditions of sale, which take precedence over all previous versions or specifications generated by the buyer, including email exchanges.

The General Terms and Conditions of Sale may be changed at any time. Any changes and/or new conditions will be effective from the moment they are published on the Site. You are therefore encouraged to regularly access the Site and consult the most up-to-date version of the General Terms and Conditions of Sale before making any purchase.

Orders

PRODUCT OFFERINGS

In the event that the requested transaction with the payment card has been authorized by the secure CartaSi X-Pay service, the order is processed on the business day following the day on which the payment was successful. All information regarding the Product offers, presented on this Site in the E-Commerce section, is valid in the LIMITE of available stock and subject to availability from suppliers. The products are presented as accurately as possible. For each product, in the electronic catalog called the E-Commerce section, the price, availability, and weight of each purchasable unit are indicated. TILE SAMPLES AND PARQUET SAMPLES

To assist in choosing the desired product, through the online purchasing procedure it is possible to request the CAMPIONE tiles and parquet that you find in the E-Commerce section of this site. The shipment of these samples can occur together with other products ordered in the same E-Commerce section of the site. The cost of this shipment is calculated based on the weight of the CAMPIONE and, if it is requested along with other products, it contributes to the calculation of the total shipping costs.

The images and descriptions on the Site are to be considered as merely indicative. I COLORI may differ from the actual ones due to the settings of the computer systems or computers you use for their display.

ORDER ACCEPTANCE

The order remains firm for the buyer from the moment of the "Order Confirmation".

ORDER CANCELLATION

Price and payment

PRODUCT PRICE

The prices of the Products are indicated in euros, including VAT. The prices displayed on this site are valid exclusively for purchase on LINE and may differ from those practiced at our headquarters and showroom FISSORE Ceramics - Moncalieri (TO).

DELIVERY CHARGES

The cost of shipping will be automatically calculated based on the weight of the items in the order and the destination location. In any case, the amount of the shipping costs is shown in the final summary, BEFORE the actual completion of the purchase procedure.

The shipping cost (even if it is free) is calculated for the unloading of the material at PIANO STRADA outside the building number.

Our couriers deliver with trucks equipped with a hydraulic tail lift and pallet jacks that are 12 meters long and 2.4 meters wide, so in the event that the STRADA indicated in the order does not allow delivery with a vehicle of these dimensions or there are any kind of limitations that prevent reaching the address, the consumer is required to indicate it to the FISSORE spa reserves the right to recalculate the shipping costs. If this does not occur, any cost EXTRA that arise for the aforementioned reasons will be charged to the buyer.

PAYMENT

The payment must be made at the same time as the order via bank transfer, credit card, or PayPal account.

In case of payment by bank transfer for tax deductions, please wait for the invoice after the order confirmation, which will be sent via email.

Delivery and return

DELIVERY METHODS

"Without prejudice to the" LIMITE general maximum imposed by theART. 6 of the D.Lgv. No. 185/1999, the ordered goods will be delivered to the consumer possibly within 4 working days starting from the working day following the receipt of the payment confirmation for the goods, without any delays constituting a reason for withdrawal from the contract or giving rise to rights to compensation, except as provided by the aforementioned. ART. 6 of the D.Lgv. No. 185/1999. With the publication of the phrase "Delivered in 2-3 days" FISSORE SpA indicates the availability of those products listed in its online electronic catalog that are in its warehouses at the time of publication. If the availability of all ordered products is immediate, as soon as FISSORE SpA will receive from the customer the total amount of the order including shipping costs, the goods will be picked up by the courier and within 3-4 working days, excluding Saturday, Sunday, and national holidays, will be delivered to the address indicated in the order. In the event that UNO or if more products from the order are not immediately available, the order, even if paid, will be processed when all the goods are available. It will still be the responsibility of the staff to FISSORE SpA inform the customer about any delays in delivery times. In any case, FISSORE is not able to guarantee that any reorders of sold-out batches can be fulfilled, in which case it will notify the consumer and proceed with the refund of the amounts already paid, in the forms and methods outlined in theART. 6 no.2 of the D.Lgv. No. 185/1999.

RECEPTION AND COMPLAINTS

The buyer must carry out all necessary inspections at the time of delivery to detect any damages, missing packages, defects, or other apparent flaws or non-conformities of the delivered products with their order. The buyer must specifically verify that the number of packages matches the number indicated on the delivery note and the condition of the packaging, which must be intact. At the time of delivery, the buyer must sign "subject to inspection." If there is any damage clearly visible from the external packaging, the buyer must add details about what appears to be damaged to the inspection reservation.

Any damaged material received must be reported via email to the address assistenza@fissore.com "by and not" OLTRE 5 days from the moment of delivery, attaching photos of the entire pallet with the damaged material still on it with the shrink wrap visible, so that the declared quantity is recognizable and countable from the photos.

Requests for replacement and/or refund that do not meet these requirements will not be processed. The buyer must also indicate whether they prefer the reordering of the damaged material or a refund of its value.

RESPONSIBILITY

FISSORE The company does not assume any responsibility for disruptions attributable to force majeure events such as accidents, explosions, fires, riots, strikes and/or lockouts, earthquakes, floods, damage to computer systems, system failures, and other similar events that prevent, in whole or in part, the execution of the contract within the agreed timeframes. FISSORE SpA will not be liable for any damages, losses, and/or costs incurred as a result of the non-performance of the contract due to the aforementioned causes, with the consumer only having the right to a refund of the price paid. Similarly, FISSORE SpA is not responsible for any fraudulent and illegal use of credit cards, checks, and other means of payment. FISSORE In fact, at no point during the purchase process is SpA able to know the consumer's credit card number, which is transmitted directly to the bank managing the service through a secure connection.

Product Warranty

WARRANTY

FISSORE SpA markets high-quality products, for which any warranty required by law is directly provided by the manufacturers, and the applicable regulations as well as the warranty application methods will be those specified and highlighted by the manufacturer along with the product.

Any manufacturing defect must be reported before assembly.

LEGAL GUARANTEES

The products are guaranteed against any non-conformity defects and hidden flaws according to the conditions provided by the provisions of the Consumer Code and the Civil Code. Extracts from the Consumer Code:

ART. L. 211-4. The seller is required to deliver a good that conforms to the contract and is liable for any lack of conformity existing at the time of delivery. Similarly, the seller is liable for any lack of conformity resulting from the packaging, assembly instructions, or installation if it is the seller's responsibility under the contract, or if it was carried out under the seller's responsibility.

ART. L. 211-5. To be in conformity with the contract, the good must: 1. ART. L. 211-12. The action resulting from the lack of conformity is prescribed for two years starting from the date of delivery of the goods.

Right of withdrawal

Consumer's right of withdrawal

The sale of products via the Internet is governed by Legislative Decree No. 206/05 (Articles 50 to 68), which regulates the matter of distance contracts, i.e., those made outside commercial premises. This legislation establishes the right of withdrawal, meaning the consumer has the option to return the purchased product and receive a refund for the expense incurred, excluding the shipping costs for sending and returning the product. This right is reserved exclusively for individuals (consumers), and therefore cannot be exercised by legal entities or individuals acting for purposes related to their professional activity. To exercise the right of withdrawal, it is necessary to send a communication expressing the intention to withdraw from the contract within 14 days of receiving the goods. The costs of returning the product are borne by the consumer.

The right of withdrawal is completely void if the returned product is not intact, that is:

lack of original packaging or inappropriate packaging;

the product has been installed;

absence of integral elements of the product (accessories, screws, components etc);

product damage.

PROCEDURE FOR EXERCISING THE RIGHT OF WITHDRAWAL

Send to FISSORE SpA, within 14 days of receiving the goods, an email communication to the address assistenza@fissore.com.

Provide, using a courier of your choice, for the shipment of the product carefully packed in the original packaging and complete with all accessories, instruction manuals, and everything originally included.

It is recommended to insure the shipment against theft and transport damage and to bear the related costs. If the returned product has not been insured for the value indicated on the invoice, in the event of damage or loss occurring during transport, FISSORE SpA reserves the right to charge for any damages incurred by deducting them from the amounts to be refunded.

FISSORE SpA will proceed, using the payment method used at the time of the order, with the refund related only to the cost of the shipped goods within 14 working days following the return shipment of the goods and in any case not before the receipt of the goods. In case of payment by bank transfer, we therefore invite you to provide the bank details and include this information in the email.

Return conditions

Return shipping costs are always the responsibility of the customer, who can return any item (except for personalized or easily perishable products) in substantially intact condition and properly stamped.

FISSORE SpA will cover all expenses in the case of defective or broken delivered items.

In the event that the order is not delivered within the expected timeframe due to reasons not attributable to us (e.g., incorrect address provided), the customer will be responsible for the redelivery and storage costs, which will be calculated on a case-by-case basis.

The purchase contract is automatically canceled when the return arrives at its destination, and the customer will be refunded within 14 days. If the customer made the payment via bank transfer, their bank details will be requested in order to process the refund.
