These general terms of sale apply to any order transmitted on the site https://www.fissore.com/en/ of FISSORE S.p.A.
The "Order Confirmation" by the buyer implies the unreserved acceptance of these general terms of sale that prevail over all previous or specific versions generated by the buyer, including the exchange of e-mail.
The General Conditions of Sale can be changed at any time. Any changes and/or new conditions will be in effect from the moment of their publication on the Site. You are therefore invited to access the Site regularly and to consult, before making any purchase, the most updated version of the General Conditions of Sale.
Orders
OFFER OF PRODUCTS
In case the transaction requested by the payment card has been authorized by the CartaSi X-Pay secure service, the order is processed on the business day after the day the payment has been successful. All information about the offers of the Products, presented on this Site in the E-Commerce section, is valid in LIMITE stocks available and subject to availability to suppliers. The products are presented as precisely as possible. Of each product, in the electronic catalogue called E-Commerce section, the price, availability, and weight of each unit can be purchased. In the case of tiles, mosaics and parquet both the weight and the price refer to 1 MQ of product.
The Products offered on the Site are limited. It can therefore happen, also because of the possibility that more users purchase the same Product at the same time, that the ordered Product is no longer available after the transmission of the purchase order.
The buyer will be informed in the event of unavailability of the ordered Product. In this case you will be entitled to terminate the purchase contract. However, please consider that before requesting the termination of the contract, the Seller reserves the right to implement these measures:
if a re-association is not possible, the Seller will provide a different product, of equivalent or higher value, after payment, in the latter case, of the difference, and after express acceptance of the user.
if a return is possible, a dilation of delivery terms, offered by the Seller, with indication of the new delivery time.
In the event of a refund of the amount paid for the purchase of Products that were then unavailable, the Seller shall refund within a maximum period of 10 days.
PIASTRELLE AND PARQUET CHAMPIONS
To help in choosing the desired product, through the online purchasing procedure you can request the CAMPIONE tiles and parquet that you can find in the E-Commerce section of this site. The shipment of such samples can take place together with the other products ordered in the same E-Commerce section of the site. The cost of such shipment is computed according to the weight of CAMPIONE and, if it is requested together with other products, it shall pay the sum of the total shipping costs.
The images and descriptions on the Site are merely indicative. I COLORI may differ from real ones due to the settings of computer systems or computers you use for their viewing.
AGREEMENT OF THE ORDER
The order remains firm for the buyer from the time of the "Order Confirmation".
ANNUAL ORDER
If after 7 days from time of order FISSORE SpA does not receive the payment the order will be cancelled.
Price and payment
PRICE OF PRODUCTS
The prices of the Products are indicated in euro, including VAT. The prices displayed on this website are valid only for purchase on LINE and can differ from those practiced at our headquarters and showroom FISSORE Ceramiche - Moncalieri (TO).
EXPENDITURE
The cost of transport will be calculated automatically according to the weight of the items that make up the order and destination location. In any case, the amount of shipping costs is reported in the final summary, before the actual conclusion of the purchase procedure.
The cost of shipping (even if free) is calculated for the discharge of the material to PIANO STRADA outside the civic.
Our couriers deliver with trucks equipped with hydraulic and transpallet 12 m long and 2.4 m wide, so in case the STRADA indicated in the order does not allow the delivery by means of these dimensions or there are limits of any kind that does not allow the attainment of the civic the consumer is obliged to indicate it to the FISSORE spa that reserves the right to recalculate shipping costs. If this does not happen any cost EXTRA for the reasons mentioned above will be charged to the buyer.
PAYMENT
Payment must be made at the same time by bank transfer, credit card or PayPal account.
In case of payment by bank transfer for tax deductions please wait for the invoice after confirmation of the order that will be sent by e-mail.
Delivery and return
CONSUMER MODE
Staying LIMITE maximum general imposed by'ART. 6 D.Lgv. N°185/1999, the ordered goods will be delivered to the consumer possibly within 4 working days starting from the following business day the receipt of the confirmation of payment of the goods, without any delays being cause of withdrawal from the contract or bring forth rights to compensation, except as provided for in the abovementioned ART. 6 D.Lgv. NO 185/1999. With the publication of the word "Consigned in 2-3 days" FISSORE SpA indicates the availability of those products listed in its online electronic catalogue at the time of publication of the same are located at its warehouses. If the availability of all ordered products is immediate, as soon as FISSORE SpA will receive from the customer the amount of the order including the shipping costs, the goods will be taken into account by the courier and within 3-4 working days, excluding then Saturday, Sunday and national holidays, will be delivered to the address indicated in the order. In case UNO or more products of the order were not immediately available, the order, if welded, will be escaped when all the goods will be available. It will still be the care of the staff FISSORE SpA inform the customer about any expansions in delivery times. In any case FISSORE it is not able to ensure that any reorders of exhausted batches may be evaded, in which case it will be communicated to the consumer and will refund the sums already paid, in the forms and in the manner referred to in the'ART. 6 n.2 of D.Lgv. NO 185/1999.
RESEARCH AND RECLAMS
The buyer must proceed, at the time of delivery, with all the inspections necessary to detect any faults, faults or other apparent defects or non-compliance of the products delivered with his order. The buyer must verify in the case that the number of packages corresponds to the one indicated on the delivery note and the condition of the packaging, which must be intact. At the time of delivery the buyer must sign '' with control reserve'. Requests for replacement and/or reimbursement will not be taken into consideration. The buyer must also indicate whether he prefers the reordering of the damaged material or the refund of the value.
RESPONSIBILITY'
FISSORE SpA assumes no responsibility for the disservices due to force majeure such as accidents, explosions, fires, tumults, strikes and/or locks, earthquakes, floods, damages of computer systems, system falls, and other similar events that prevent, in whole or in part, from performing in the agreed time of the contract. FISSORE SpA shall not be liable for any damages, losses and/or costs incurred as a result of the failure to implement the contract for the abovementioned cases, having the consumer only entitled to return the price paid. Similarly FISSORE SpA is not responsible for any fraudulent and unlawful use of credit cards, cheques and other means of payment. FISSORE SpA, in fact, at no time of the purchase procedure is able to know the number of credit card of the consumer who, through protected connection, is transmitted directly to the Bank of the service.
Warranty of products
WARNING
FISSORE SpA sells products of a high quality level, for which the possible guarantee provided by law is directly provided by the manufacturers and the reference legislation and the methods of application of the guarantee will be those indicated and highlighted by the manufacturer together with the product.
Any production defect must be communicated before the installation of the same.
LEGAL GUARANTEES
The products are guaranteed against any defects of conformity and hidden defects according to the conditions laid down in the provisions of the Consumer Code and the Civil Code. Extracts of the Consumer Code:
ART. L. 211-4. The seller is required to deliver a good in accordance with the contract and responds to existing compliance defects at the time of delivery. In the same way, he responds to the lack of conformity resulting from packaging, assembly instructions or installation if it is at its expense on the basis of the contract, or was carried out under his responsibility.
ART. L. 211-5. To comply with the contract, the good must: 1. Be suitable for use normally provided for a similar good and, according to the cases, correspond to the description given by the seller and possess the qualities that it presented to the buyer in the form of CAMPIONE or model; submit the qualities that a buyer can legitimately expect with respect to public statements made by the seller, the producer or its representative, in this case in advertising or labelling; 2. Or present the characteristics defined by common agreement between the parties, or be provided for any special use sought by the buyer, brought to the knowledge of the seller and that the latter is accepted.
ART. L. 211-12. The action resulting from the lack of conformity prescribes for two years from the date of delivery of the goods.
Right of withdrawal
Right of withdrawal of the consumer
Sales of products via the Internet are governed by Legislative Decree no. 206/05 (art. 50 to 68) which regulates the subject matter of distance contracts, that is carried out outside commercial premises. This legislation stipulates the right of withdrawal, i.e. the possibility for the consumer to return the purchased product and to obtain the refund of the expenses incurred excluding the forwarding expenses. This right is reserved exclusively for natural persons (consumers), so it cannot be exercised by legal persons and natural persons acting for purposes related to the professional activity which may be carried out. To exercise the right of withdrawal it is necessary to send, within 14 days from receipt of the goods, a communication in which the will to withdraw from the contract is manifested. The costs of returning the product shall be borne by the consumer.
The right of withdrawal shall be deemed to be in full if the returned product is not intact, or:
• lack of the original packaging or packaging not congruous;
• the product has been installed;
• absence of integral elements of the product (accessories, screws, components etc);
• product damage.
PROCEDURE FOR THE EXERCISE OF THE RIGHT OF RECESS
In case - having made a purchase at our site fissore.com - you want to withdraw from the purchase, you will need to follow this simple procedure:
Send to FISSORE SpA, within 14 days of receipt of the goods, a communication by e-mail at assistance@fissore.com.
Provide, by using a courier of your choice, the shipment of the product carefully packed in the original and complete packaging of each accessory, instruction manuals and everything originally contained.
It is recommended to ensure against theft and transport damage the shipment and take charge of the related expenses. If the product has not been insured for the value indicated in the invoice, in case of damages or loss occurred during the transport, FISSORE SpA reserves the right to charge any damage suffered by holding them from the sums to be refunded.

FISSORE SpA will proceed, by means of the payment method used at the time of the order, to the refund relative to the only cost of the goods sent within the 14 working days following the return of the goods and however not before the receipt of the goods. In case of payment by bank transfer, please indicate the bank details and include this information in the email.
Return conditions
Shipping costs for return are always borne by the customer who will be able to return any item (except for customized products or easily deductible) under conditions of substantial integrity and properly affrancato.
FISSORE SpA will be charged with all expenses in the case of items delivered defective or broken.
In the event that the order is not delivered in the terms provided for for causes not attributable to us (e.g. address provided that is incorrect) will be charged to the customer the costs of delivery and the costs of deposit, which will be calculated from time to time.
The purchase contract is automatically canceled when the return arrives at the destination and the customer will be refunded within 14 days. If the customer has made the payment by transfer, his bank details will be requested to be able to make the refund.
